On March 6, 2024, the U.S. Department of Commerce (DOC) issued the final results for the 19th administrative review (POR19) of anti-dumping duties (AD) on frozen tra fish fillets from Vietnam, covering the period from August 1, 2021, to July 31, 2022.
Previously, on August 31, 2023, DOC released the preliminary results for POR19. In these preliminary results, two mandatory Vietnamese respondents were assigned preliminary AD rates of {content},00/kg and {content},14/kg. Additionally, four companies qualified for separate rates at {content},14/kg; ten companies were preliminarily determined to have no shipments during the review period, and eight companies did not have valid review requests. The remaining companies were assigned the Vietnam-wide rate of {content},14/kg due to ineligibility for separate rates. These preliminary rates represented a significant reduction from the final results of the previous review (POR18), which had separate rates at $1.94/kg and the Vietnam-wide rate at $2.39/kg.
In the final results, after verifying the responses from Vietnamese companies and considering comments from interested parties, DOC adjusted the AD rates for the two mandatory respondents to {content},00/kg and {content},18/kg. Accordingly, the four companies eligible for separate rates were assigned a rate of {content},18/kg, which did not significantly change from the preliminary results.
However, regarding the Vietnam-wide rate, DOC concluded in the final results that there were no shipments from companies assigned the Vietnam-wide rate during the review period, making it insufficient to assess a Vietnam-wide rate for POR19. Consequently, DOC rescinded the review of the Vietnam-wide rate for POR19. Thus, the Vietnam-wide rate will continue to be applied based on the most recent prior review result (POR18) at $2.39/kg. The preliminary rate of {content},14/kg provided in the preliminary results was only provisional, and in the final results, DOC reverted to the previous Vietnam-wide rate.
Currently, DOC is conducting the next administrative review (POR20) for Vietnamese frozen tra fish fillets exported to the U.S. from August 1, 2022, to July 31, 2023.
