As part of the 2024 Government work program, the Prime Minister assigned the Ministry of Industry and Trade to lead the drafting of a decree to replace Decree No. 10/2018/ND-CP dated January 15, 2018, detailing several provisions of the Law on Foreign Trade Management on trade remedies (hereinafter referred to as the Decree). Implementing the plan for drafting legal normative documents, on April 12, 2024, the Ministry of Industry and Trade organized the first meeting of the Editorial Team to draft the new Decree. The meeting was attended by most members of the Editorial Team and representatives from relevant ministries and agencies, including the Ministry of Finance (General Department of Customs), Ministry of Justice (Department of International Law), Vietnam Chamber of Commerce and Industry (VCCI), and various departments within the Ministry of Industry and Trade, such as the Legal Department and the Import-Export Department.

Speaking at the meeting, Mr. Trinh Anh Tuan, Director General of the Trade Remedies Authority, Ministry of Industry and Trade, and Deputy Head of the Editorial Team, outlined the specific content, including the necessity of issuing the Decree, the drafting plan, the Decree outline, and six major groups of issues that need to be amended and supplemented.

Members of the Editorial Team focused on providing opinions on issues related to the scope of the Decree to ensure alignment with sectoral management laws, trade remedy laws, and methods for amending and supplementing to address practical application limitations and obstacles. They also discussed administrative procedures regarding exemptions from trade remedy measures, regulations on anti-dumping, countervailing duties, safeguards, and anti-circumvention measures, trade remedy reviews, and methods for seeking compensation and retaliation if Vietnamese traders are subject to trade remedy investigations by importing countries.

The Editorial Team unanimously approved the drafting agency’s proposals for the six major groups of issues requiring amendments and supplements, along with other technical matters. Based on the feedback from Editorial Team members and relevant parties, the team will compile and finalize Draft 01 of the Decree and send it to relevant agencies, organizations, individuals, industry associations, and the business community for comments in accordance with regulations. These comments will serve as an important basis for the Ministry of Industry and Trade to continue researching, supplementing, and finalizing the draft Decree for submission to the competent authority for issuance according to regulations.
